Terms and Conditions
DEFINTION OF TERMS
- A ‘client’ is any person, persons, business or organisation using any of the services provided by Adam Grannell.
- A ‘contract’ is any work undertaken or service provided by adamgrannell.co.uk on the request of a client.
- ‘Content’ is both text and images that the client requires on the website.
- ‘Domain names’ are the website address as specified by the client.
This document defines the terms and conditions of using this website. All web projects or services that adamgrannell.co.uk may be contracted to produce or provide for client will be subject to the following:
CONTRACTS
Work will begin work upon client’s approval of the quotation provided. Your approval (written or oral) will constitute an agreement between a client and adamgrannell.co.uk.
NATURE OF WEBSITE CONTENT
The client is fully responsible for the content of their website. It is the client’s responsibility to check that the content of a web project is accurate including text, facts and figures such as interest rates, which must be checked at source.
The website must be legal within UK law, and the client must be able to substantiate all claims and representations. They are responsible for all trademark, service mark, copyright and patent infringement clearances.
We will not tolerate any websites that are incite hatred, violence, or any content that is defamatory or seeks to harm people and reputations of people and/or organizations. Any web site found to be of this type will be deleted with out notification.
PAYMENT
Each contract will require 50% of the proposed project cost to be paid before work can begin. Payments can be made by personal cheque. We currently do not have facilities to accept credit or debit cards.
After completion of the project, all remaining costs/fees must be paid. We reserve the right to refuse completion or delivery of website work until due cost/fees are paid.
CANCELLATION
In the event that the project is cancelled and development of a website has progressed beyond the design stage 50% of the proposed the project costs must be paid.
REFUNDS
Please note that annual payments and instant Paypal payments can not be refunded once the website and its services have been set up and available online, or if you decide to switch web hosting providers part way through the year.
Refunds will be issued in the following cases:
- where a website or service has been unavaiable for more than 1 day due to vendor problems beyond the control of adamgrannell.co.uk and causing loss of business, for example email features failing or website being inactive. In such cases web hosting fees for the month corresponding to the problems will be refunded, or not charged for that those months.
- where a domain names registered with us has been released in error and or not been renewed in time and so fees for the domain name will be refunded.
NON-PAYMENT
In the event of non-payment, we will contact you to inform you of what is outstanding.
However we reserves to right to deactivate your website or release your domain name if registered or hosting in the following cases:
- the period for payment has exceeded more than 2 months
- a domain name has not been paid for after 2 months
- the client contact has not been reached after all methods have been made to make contact through calls by telephone and emails.
The following non-payment process will be started non-payment arises.
- A months notice in the form of email and telephone call will be sent to you indicating your website and or domain name will be deactivated due to non payment a month before deactivation of your website and domain name. This will show what funds are outstanding and invite payment by cheque or standing order.
- In the following month an email notice will be sent stating your website and or domain name have been deactivated, what funds are outstanding and that your contract will be terminated.
WEB HOSTING & SITEBUILDER
All web hosting packages include space for web pages and content, all standard email boxes, scripting (ASP, ASP.NET). Extra features can be added, for example additional mail box space or more sophisticated mail boxes such as Microsoft Exchange mail boxes, and will be charged for individually.
Web Hosting is charged on a monthly basis and payable using one of two methods:
- Monthly Standing order
- Personal cheque every month
- Annual Payment
Annual Payments
Web Hosting fees can be paid on an annual basis and suits some customers rather than monthly payments.
WEBSITE MAINTENANCE
Maintenance work is at the sole discretion of adamgrannell.co.uk and may be charged for at the standard rate of £25 per hour. Minor changes to existing content will need to be made over time in order to keep content fresh and up to date. Large amounts of updates and or changes incurring more than one hour of time to complete may be regarded as upgrades and therefore may be subject to charges at the standard rate.
Maintenance fees are payable by personal cheque.
DOMAIN NAMES
Domain names will need to be purchased separately when web hosting is set up and will be registered by adamgrannell.co.uk who will register the domain name to the client’s current work/home address. The client will be the legal owner of the domain and if they request to have details changed or the domain transferred elsewhere, adamgrannell.co.uk will do this within reasonable time and charge and admin fee.
Domain names registered through adamgrannell.co.uk will be renewed automatically each year. Fees incurred will not be charged for separately as they form part of the monthly/annual hosting fees.
If a domain name is registered with another domain name registrar and the web hosting package used by a client uses the domain name it is the responsibility of the client to renew their domain names. If a domain name expires, adamgrannell.co.uk cannot be held liable for this.
SERVICE PERFORMANCE
We will endeavor to provide a reliable and professional hosting service for clients at all times and cannot be held responsible for technical failure of the web hosting provider (Fasthosts Internet Limited) which is beyond the control of adamgrannell.co.uk.
TERM AND TERMINATION – The terms of this agreement will continue until terminated by either of adamgrannell.co.uk upon 1 months written or oral notice and when any of the following apply.
- You wish to move web hosting provider and so may take copies of your website and move your domain name, if registered and hosted with adamgrannell.co.uk. Please note that annual Web Hosting fees cannot be refunded once the website is set up and available online, or if you decide to switch web hosting providers.
- You wish to discontinue your website and or hosting because you no longer need them.
- You are dissatisfied with the service and given a reasonable argument for dissatisfaction.
No part of the adamgrannell.co.uk website may be reproduced, copied, modified, distributed, republished, uploaded, posted, transmitted, sold, commercially exploited, publicly displayed or publicly performed in any form or manner without the prior written permission by adamgrannell.co.uk.
We reserve the right to publish for promotional and marketing needs any work created for clients in the portfolio section of the website. We will store computer disks copies and backups for a period of 6 months beyond the delivery of a job and reserves the right to discard them.
DATA AND PRIVACY
adamgrannell.co.uk is the sole owner of the information collected from you via the contact form or via telephone or email when you begin a contract. Information includes name and contact information and business/home address and will be used purely to carry out admin and collecting payment as regards with your contract. There are no circumstances under which, this information might be passed to a third party.
ADDITIONAL PROVISIONS
The validity and enforceability of this agreement will be interpreted be interpreted under the UK Law, and you agree that such a contract will be subject to the non-exclusive jurisdiction of the UK courts.
adamgrannell.co.uk reserves the right to alter these terms and conditions and policies accordingly.
